This is a blog of the prosecution of  Benjamin Gilmore, a local beekeeper whom many believe was wrongfully prosecuted and convicted for the Penny Flats fire that happened in downtown Fort Collins on October 24, 2011. He made the mistake of being associated with the Occupy Fort Collins movement, and had let them borrow a camper for their use. The Occupy Fort Collins demonstration was one block east of the Penny Flats building which was under development at the time. The discrepancies in this prosecution merit note, and it shows some of the drawbacks of prosecutions in the Eight Judicial District of Colorado:

  • It's not about justice, it's about getting a conviction.
  • It's not about truth, guilt, or innocence, it's about what you can get a jury to believe.

An Open Note to the People Who Dropped Off Two Cats Around 1st Street and 287 in Loveland

WHAT WERE YOU THINKING? The female, who was such a friendly, pretty kitty, didn't survive 287. The male is now there, alone, and pining for his sibling. Still hungry, still cold, and NOW ALONE! No matter what your circumstance, there is a thing called the Humane Society that would have taken them both in. I won't judge you, because only God is the judge, but what a damn unnecessary shame. If I would have known they were abandoned, I would have gotten them in a carrier and taken care of it. Not knowing, and not knowing there was a pair, I left the female there, not wanting somebody to loose their cat… This was two Fridays ago, and she didn't look abandoned, so somebody had dropped them off within a couple of days. She came up giving me the hungry meow, being all friendly and sweet. I got her away from the street and into the yard behind the building, not wanting her to be run over by a vehicle. To no avail. Sorry pretty kitty, I let you down, and I can't undo what happened…

Folks, PLEASE DON'T ABANDON YOUR CAT. Take the time and have the human decency to take it to the Humane Society. Don't let the world's coldness fill your heart...

Standing with Kim Davis... Chazak ve'ematz!

Lets go back a few centuries to the Founding Fathers. See those guys? Do you think they put an obscured right in the Constitution about gay marriage? That only a court in 2015 can see and fathom? Can you envision that? Can you envision Superman flying around pregnant? Because that is what it compares to for the Supreme Court to say that the United States Constitution somehow embraces the right to gay marriage. Really? If you believe so, then you need to research the Founding Fathers and what they believed in. Sodomy was not one of the things that they upheld…

So I TOTALLY stand with Kim Davis, that Kentucky county clerk who was jailed for contempt by a Federal District Court judge for refusing to issue gay marriage licenses. Rightful contempt of an illegal order. I stand with Kim Davis for having the moral conviction to stand up to judicial tyranny.  I stand with Kim Davis for refusing to compromise on a question of following God or following the world. Chazak ve'ematz Kim! Stay strong, because God is on your side and

Randy Jensen has a 2½ day trial beginning tomorrow at 11:00am in Judge Berenato's court, 5D

Randy has been sitting in LCDC way too long for these BULLSHIT charges – he had a public defender who told him it was ok to communicate with the mother of his twin babies. He wrote her letters and called her from the jail, whence three different deputies reported him for violating a restraining order that he thought had been lifted. Every time he turns around they add charges and jail time. Randy has a new PD, the old one will be called as a witness. New one, as related by confidential sources, is not a ball of fire.

There is no need for a restraining order, the mother was never a victim. It was an automatic one and seems to remain despite the babies' mother's letters and in-court pleas to drop the restraining order. Seems the grandma is driving it – 

Shame on the Coloradoan for their reporting on the Dyers...

Here's another example of the Coloradoan going on the offensive to insure that somebody is tried in the press, and that a fair trial is impossible in this corrupt county. The Coloradoan and it's staff should be ashamed of the way they have reported on the Dyers! They should resign en masse or be fired, because what they have done is akin to burning a cross in the Dyers' front yard. They should be sued for libel at minimum for publishing unsubstantiated allegations and for not properly following up on their leads.

Lets look at one example… "I didn't even know they ever had a daughter," said Louisa Lombardo, 32. Lombardo has lived with her husband and two children in the 100 block of East Trilby Road since January. Though they moved in two months after a 7-year-old girl was removed from Douglas and Leah Dyer's custody next door, Lombardo said she was still taken aback. …Why even post that nonsense? If the lady and her family moved in two months after the child was taken, WHY WOULD SHE KNOW? Is she taken aback by her own ignorance? Has she attempted to meet the neighbors? Has she ever gone through the trauma of getting a child ripped out of the home by CPS? PLEASE…

Ever read a book that really pissed you off?

One of those that gets your blood boiling, your blood pressure and heartbeat up? If you have you know the feeling. I just finished reading through such a book. The name of the book is "Drawn to Injustice", by Timothy Masters with Steve Lehto. It's well worth whatever they charge for it.

Having done my share in removing Judges Blair and Gilmore in 2010, what gets me pissed is that I've personal experience with some of these individuals, and the shell game they play with both justice and truth. How many more perpetrations in Larimer County remain undiscovered? How many more innocents sent from this jurisdiction to DOC on false testimony, malfeasant prosecution, and with the help of the fantasies of statistical phrenologists? Innocents that just didn't have the luck of drawing a Maria Liu… You know, where there is smoke there is fire, and an iceberg only shows 10% of it's volume above the surface.

It irks that as you read, you find out that one of the main individuals who fought TOOTH and NAIL to prevent justice for Tim Masters after Maria Liu became involved was Cliff Riedel, who got 'elected' in our judicial district to District Attorney in 2012. 'Elected' in quotes

I was recently contacted by a victim and example of corruption in this community. She wants her story publicized, and I'm more than willing to oblige, because she is computer illiterate. Those of you here in Choice City {for whom, BTW} may remember the story of Holiday Christy, who was portrayed as this monster animal abuser. I wrote about it back in August, 2011. The fact is that she had the misfortune to get fuel on I-25 and Harmony in this community. She was traveling with all of her animals, including a number of breeder dogs, to a new life in Texas. One animal got loose, got hit, and all of a sudden law enforcement and Animal Control, aka The Humane Society is involved.

To make a long story short, I believe that somebody found out that she was carrying hard cash and had breeder animals, and snatched her animals, arresting her and falsely accusing her of animal abuse. The legal fraud to that, is that from Fort Collins to Texas is less than 24 hours. The animals were not being abused in any way, they were being transported in cages with food and water. They demanded $6300 to get back the animals, inventing

Banning Panhandelers: How the County Commissioners may waste more of our tax dollars

So the Commissioners are about to take a vote on banning panhandling, like on the medians at Timberline and Mulberry (Hwy 14), as reported by the Coloradoan. I would recommend that the Commissioners attempt to do no such thing, lest they get us embroiled in a lawsuit with the ACLU as Colorado Springs has here recently.

Why would the ACLU take up the case of the panhandler? Because it is a First Amendment free speech issue for both the panhandler and driver. He (or she), the panhandler, has a First Amendment right to discuss anything with me unless I refuse so. I have the right to discuss, or not, whatever I want with that panhandler once approached. That discussion can range from the weather to the design of nuclear weapons. It can also include an entreaty for a pecuniary gratuity. And I can give it or not, at my choosing. These are all basic First Amendment rights in America. If you don't want to talk to them, you keep your window rolled up, or tell them so. If you do, you roll your window down. It's no big deal.

We see mug shots every day in the Coloradoan.  Mug shots of our neighbors.  Some guilty, some innocent, some undercharged but most overcharged; some for misdemeanors, and some for felonies.

That’s just how it works.  You are accused and arrested.  Finger printed and photographed.  Lice showered and told to spread your ass cheeks and cough.

Even when the charges against you are dropped, as they were against a young guy named Temple, we still see his mug shot rather than a more appropriate picture of a free innocent man celebrating his vindication.
